Terms and Conditions

1. Acceptance of the terms

By downloading, installing or using the BIMS plugin ("the Software"), you agree to be bound by these Terms and Conditions. If you do not agree with any of these terms, do not use the Software.

BIMS is a plugin for Autodesk Revit developed and marketed by BIMS, with RUC (tax ID) and contact details available in the contact section of this site.

2. License terms

BIMS grants the user a personal, non-exclusive, non-transferable and revocable license to use the Software under the following conditions:

• Individual Plan: use on 1 (one) device per registered user.
• Professional Plan: use on up to 3 (three) devices per registered user.
• Enterprise Plan: number of devices as set out in the contract agreed with BIMS.

Restrictions

• You may not decompile, reverse-engineer or modify the Software.
• You may not remove intellectual property notices from the Software.
• You may not use the Software for unlawful purposes or in any way that infringes the rights of third parties.
• You may not create additional accounts or use technical means of any kind to obtain the trial period repeatedly, circumvent its limits or extend free access.

3. Plans, prices and payments

Trial period

BIMS offers a free evaluation period of 14 days from the first activation, with no payment details required. When the trial period expires, the Software is deactivated until a plan is purchased.

Legitimate use of the trial

The free trial exists so that you can evaluate BIMS before buying it, and it is granted once per person, company and machine. During the trial, some features process a limited number of elements; that limit does not apply to paid licenses.

To keep the trial available to those who genuinely need it, the following are not permitted:

• Signing up with temporary or disposable email addresses, or with addresses created in order to obtain the trial period again.
• Opening several accounts —using different emails, aliases or variants of the same email— to chain one trial after another.
• Reusing the same machine to start trials under different accounts.
• Altering the Software, its communication with our servers, or your machine identifiers in order to circumvent the trial limits.

We verify these conditions automatically at sign-up and at login. If a breach is detected, we may deny or revoke access to the trial without prior notice; this does not affect paid licenses already in force. If you believe your access has been restricted in error —for example, because you share a machine in an office, on a site or in a university lab, or because you changed your email address— write to soporte@bimsaddin.com and we will sort it out.

One-time payment plans

You may purchase a license for a term of 1, 3, 6 or 12 months through a single, non-recurring payment. The license expires at the end of the purchased term.

Subscription plans

Under the subscription model, you are billed automatically on a monthly basis. You may cancel at any time without penalty, and the license will remain active until the end of the period already paid for.

• Individual Plan 6 months: S/ 300
• Individual Plan 12 months: S/ 596
• Professional Plan 1 month: S/ 100
• Professional Plan 3 months: S/ 268
• Professional Plan 6 months: S/ 500
• Professional Plan 12 months: S/ 996

All prices include IGV (VAT). BIMS reserves the right to modify prices with a minimum of 30 days' prior notice.

4. Returns and refund policy

Right of withdrawal

In accordance with the Consumer Protection and Defense Code (Law No. 29571), the user has the right to request a full refund within 7 calendar days following the payment date, provided that:

• The Software has serious technical faults that prevent its normal use and BIMS has been unable to resolve them within a reasonable timeframe.
• The Software has not been activated or used on any device.

Request procedure

• Send an email to soporte@bimsaddin.com with the subject "REFUND REQUEST".
• Indicate: full name, registration email, transaction number and reason.
• BIMS will respond within a maximum of 5 business days.
• An approved refund will be processed within 7 to 15 business days depending on the payment method used.

5. Updates and support

Software updates are published on this website and are available to all users with an active license at no additional cost.

Technical support is provided according to the contracted plan:

• Individual Plan: email support with a response within 48 business hours.
• Professional Plan: priority support with a response within 24 business hours.
• Enterprise Plan: dedicated support, training and customization as per contract.

6. Intellectual property

The Software, its source code, design, documentation and all associated elements are the exclusive property of BIMS and are protected by the intellectual property laws of Peru and international treaties.

Autodesk and Revit are registered trademarks of Autodesk, Inc. BIMS has no official affiliation with Autodesk.

7. Limitation of liability

The Software is provided "as is". BIMS does not warrant that the Software will be uninterrupted or error-free. Under no circumstances shall BIMS be liable for indirect, incidental or consequential damages arising from the use of the Software.

BIMS's total liability to the user shall not exceed the amount paid for the current license.

8. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Peru. Any dispute shall be submitted to the competent courts of Lima, Peru, or resolved through the INDECOPI system if so requested by the user.
